Ultimate Coffee Company Limited (UCCL) has its registered
office at Room 5, 13/F Wah Wai Centre 38-40 Au Pui Wan Street, Fo Tan, Hong
Kong. The websites and mobile applications (collectively, the “Sites”) are
owned and edited by UCCL.
These terms of use (“Terms of Use”) govern your use of UCCL
Sites. In these Terms of Use, we use the terms UCCL, “we”, “us” and “our” to
refer to the head office of Ultimate Coffee Company Limited at the registered
address above and its affiliates.
Please read these Terms of Use carefully before using the
Sites. It contains important information about your rights and obligations
because it contains significant information about your rights and obligations,
as well as limitations and exclusions that may apply to you.
This Sites contain the current terms and conditions that
apply to your purchase from us on orders for coffee beans, coffee powder,
coffee machines, beans grinders, tea, chocolate powder and/or related or
peripheral products or related services. You acknowledge that you are fully
aware of the contents of these terms and conditions and, on placing any
purchase order for Products / Services, you agree to be bound by and accept
these terms and conditions.
B. Modification of Sites Terms
UCCL reserves the right to modify these Site Terms
periodically and the latest version of these Terms of Use will always be
available on the Sites. By continuing to use the Sites, you agree to be bound
by the terms of these updates and amendments.
C. Copyright / Intellectual Property
This entire Sites is copyrighted under the Law of Hong
Kong Special Administrative Region and protected by worldwide copyright laws.
Users of the site may download or print a copy of any materials on the
site for personal, non-commercial use, provided that they do not modify the
materials in any way, nor delete or change any copyright or trademark notice.
None of the information on this Sites may be copied, distributed or
transmitted in any way for commercial use without the written consent of UCCL.
UCCL reserves full ownership of the intellectual property rights in any
materials downloaded from this Sites.

UCCL tries to ensure that the information provided is
accurate and complete. However, UCCL does not warrant or represent that
UCCL’s Material is accurate, error-free or reliable or that use of UCCL

third party sites then this is at your own risk. UCCL does not authorize

reasonable precautions to protect your personal information from loss, misuse
or alteration. Further, our policies and measures are complying with the
provisions of Cap. 486 Personal Data (Privacy) Ordinance of HKSAR.

You have the right to ask for access to any personal
information that we hold about you in our records, to update any outdated
information and to erase your personal information.
You have the right to object to us processing your
personal information, such as you can ask us to stop sending you direct
marketing communications at any time. If you wish to exercise any of these

CONDITION OF SALE
A. General
These Conditions of Sale (“Conditions”) are applicable to
all offers, orders, confirmations, invoices and agreements by virtue of which
UCCL undertakes to supply Goods and/or Services to Buyers after confirmation of
Orders submitted by the Buyer through UCCL’s Website. UCCL reserves the
right to change the following Conditions at any time without prior notice.
B. Ordering Process
1. Buyer’s Orders on our Website are without commitment
and constitute an offer from the Buyer to the UCCL to buy the Goods in Buyer’s
Order. Order shall only be binding if and when confirmed by UCCL when
sending to Buyer the shipment confirmation or a notice that the Goods are ready
for collection.
2. During the processing of an Order, UCCL will confirm
the availability of Goods. The Goods are displayed on our website does not
constitute or imply a warranty that the Goods are available. In case the
Goods are unavailable, UCCL shall inform Buyer as soon as possible by email
about the situation. Buyer shall have choice to wait until the Goods are
available or to cancel the order. Once the Buyer confirms to wait for the
Goods, the Buyer will no longer be able to cancel the order and no refund will
be available.
C. Price & Payment
1. All the payment shall be made by the methods are as
displayed on the payment page of the Website, and payments shall be done in the
Hong Kong Dollars currency as indicated on the invoice.
2. The Customer shall bear the price differences due to
exchange rate and / or any other charges incurred for whatever reasons by the
credit card issuer for all transactions.
3. UCCL will use its reasonable efforts to ensure, but
cannot guarantee that the prices stated in the on-line store are accurate. UCCL
reserves the right to correct any incorrected prices and will inform the
customer as soon as possible. In this situation, the customer can choose
to reconfirm the order or to cancel the order with refund.
D. Delivery
1. Delivery Service Arrangements
If any purchase over HK$800 per transaction: We
offer free delivery service.
If any purchase below HK$800 per transaction: We
will charge HK$150 per delivery or SF Express Pick Up (Pay by Recipient)
2. Applicable to only single delivery address for each
purchase.
3. Delivery service covers Hong Kong Island, Kowloon and
the New Territories, except 1.) the outlying Island (i.e. Discovery Bay, Ma
Wan, Lantau Island, Cheung Chau and etc.), 2.) the remote area of New
Territories (i.e. Lok Ma Chau, Lo Wu, Tin Shui Wai and Kam Tin etc.) and 3.)
the Southern District and the Mid-level / Peak of the Hong Kong Island, the
additional charges may be applied for delivery services to these area.
Any delivery address is not within HKSAR, please contact our Customer
Care Hotline (852 2947 7248) for the details.
4. Our delivery service does not cover locations
that are not directly accessible by courier trucks or floors that are not
directly accessible by elevators. Thus, most of the village houses are not
covered by our delivery service.
5. For unsuccessful delivered orders, we will contact you
by next day for the re-delivery arrangement, and extra HK$150 or above will be
charged.
6. During the Black Rainstorm Warning Signal or Tropical
Cyclone Signal No. 8 (or above) is hoisted, all the delivery will be suspended.
E. Exchange and Return Policy
Exchange and Return Policy
1. The products (i.e., Coffee, Tea and Chocolate powder,
etc.) which you purchased from our online shop could only be exchanged or
returned within 3 days of delivery date and with the following circumstances:
- Item(s) is having
quality issue, which is the “best before date” has passed;
- Item(s) was
delivered in mistakes on either the quantity or items due to UCCL shipping
error;
2. All the equipment (Coffee Machines, Grinders and
Accessories) will not be acceptable for any exchange or return. Most of
these items are covered with the original factory’s warranty, please consult
with our Customer Care Hotline +852 2947 7248 before making a purchase.
Exchange or return the goods Procedures
If customer would exchange or return the goods, please
follow the steps as below:
1. Please contact our Customer Care office by email
(ucclservice@ultimatecoffee.com.hk) within 3 days of purchase (including public
holidays).
2. Please provide the invoice copy, reasons of exchange
or return and supporting pictures, etc. Our Customer Care Officer will inform
you about the decision by email.
3. Once you receive the confirmation email, please pack
the return items properly and send to us with the copy of email confirmation
and delivery note within 7 days since you receiving the confirmation email from
our Customer Care Officer. We could refuse to accept any applications of
exchange or return if over 7 days limit. In addition, the shipping charge
is at customer’s expense.
4. UCCL reserves the final right to interpret the terms
and conditions of this policy.
Remarks:
Before we proceed the exchange or refund, we will examine
the returned goods condition and it should be complied with our exchange and
return policy. Otherwise, we will not return the unqualified returned
items to the customer. Therefore, the Customer should make sure the
returned goods are qualified with our exchange and return policy.
F. Applicable Law
1. These Conditions and any Agreement based on these
Conditions shall be governed by and construed in accordance with the laws of
Hong Kong Special Administrative Region.
